UEIP Azores – Photo Tours and Tourist Activities

UEIP Azores is dedicated to the provision of tourist services, namely photo tours, guided experiences and tourism-related activities in the Azores. No physical goods are sold or delivered. All contracts entered into by UEIP Azores relate exclusively to the provision of services, in accordance with applicable Portuguese law.

Service Provision Conditions

The services provided by UEIP Azores are delivered on the date, time and location agreed at the time of booking. Confirmation of the booking is subject to full or partial payment of the service, as indicated in the specific conditions presented to the client prior to contracting. The client undertakes to attend the activity at the agreed place and time and to comply with all instructions provided by the UEIP Azores team, including safety requirements, minimum physical conditions and rules of conduct during the activity.

UEIP Azores reserves the right to modify or cancel a service due to force majeure, namely adverse weather conditions, safety risks to participants, legal restrictions or other circumstances beyond its control. In such cases, an alternative date will be proposed or, if this is not possible, a refund will be issued in accordance with legal requirements.

Right of Withdrawal from the Contract

Under Decree-Law No. 24/2014 of 14 February, which regulates distance and off-premises contracts, consumers generally have a period of 14 consecutive days to exercise the right of withdrawal from the contract without providing any reason. However, as these are tourist services with a specific date or period of performance, the legally established exceptions apply.

Exceptions to the Right of Withdrawal

In accordance with Article 17 of Decree-Law No. 24/2014, the right of withdrawal does not apply to contracts for leisure services, including tourist activities, where a specific date or period of performance is provided and the consumer has been duly informed of this condition prior to the conclusion of the contract. Accordingly, bookings for UEIP Azores photo tours and tourist activities with a scheduled date are not subject to withdrawal after confirmation, except in the cases expressly provided for in the cancellation conditions set out below.

Cancellation and Refund Policy

The client may request cancellation of a booking by written contact via info@ueipazores.com. Refund conditions depend on the notice period relative to the scheduled date of the service. Where cancellation is requested within the time limits indicated in the specific conditions of the activity, a full or partial refund may be granted, as previously communicated at the time of booking.

No refund will be due in cases of non-attendance, significant delays attributable to the client or cancellation requests made outside the established deadlines, except where legally mandatory or in cases of duly proven force majeure.

Where cancellation results from a decision by UEIP Azores and rescheduling is not possible, the client shall be entitled to a full refund of the amounts paid, using the same payment method, within a maximum period of 14 days, in accordance with Article 12 of Decree-Law No. 24/2014.

Interruption or Non-Execution of the Service

If an activity has commenced and is interrupted due to safety reasons, adverse weather conditions or other unforeseeable circumstances, UEIP Azores will assess each situation individually and may propose repetition of the activity, rescheduling or a proportional refund, always in accordance with applicable law.

Alternative Dispute Resolution

In the event of a consumer dispute, the consumer may resort to an Alternative Dispute Resolution entity, in accordance with Law No. 144/2015 of 8 September, which can be consulted at https://dre.pt/dre/detalhe/lei/144-2015-70303382.

For services provided by UEIP Azores, consumers may, for example, contact the Consumer Arbitration Centre of the Autonomous Region of the Azores, whose information is available at https://www.arbitragemacores.com.
